Terms and Conditions
of SUP Prague
These Terms and Conditions apply to all activities organized by SUP Prague, operated by Samuel Peška, CIN 04926340, based in Prague, Czech Republic.
By making a booking, paying for an activity, or participating in an activity, the booker and all participants agree to these Terms and Conditions.
1. Responsibility of the Booker
The person making the booking confirms that they are authorized to make the booking on behalf of all members of their group.
The booker is responsible for informing all participants in the group about these Terms and Conditions before the activity begins.
By agreeing to these Terms and Conditions, the booker confirms that all participants in the group agree to follow the safety instructions, rules, and conditions set by SUP Prague.
The booker accepts responsibility for any damage to equipment, property, or other participants caused by themselves or any member of their group, unless responsibility is transferred directly to the individual participant through a separate written agreement.
2. Health and Fitness
All participants confirm that they are physically able to take part in the activity.
Participants must inform SUP Prague before the activity about any medical condition, injury, limitation, disability, fear of water, pregnancy, medication, or any other circumstance that may affect their ability to safely participate.
SUP Prague reserves the right to refuse participation to anyone who appears unfit, unsafe, unable to follow instructions, or unable to safely take part in the activity.
No refund is provided if a participant is refused participation due to health, fitness, intoxication, unsafe behavior, or failure to follow instructions.
3. Alcohol, Drugs and Unsafe Behaviour
Participants must not be under the influence of alcohol, drugs, or any other substances before or during the activity.
SUP Prague reserves the right to refuse or stop the participation of any person who appears to be under the influence of alcohol or drugs, behaves dangerously, ignores instructions, or puts themselves, other participants, staff, or equipment at risk.
In such cases, no refund will be provided.
4. Safety and Risk
Participants acknowledge that water-based activities on the Vltava River involve inherent risks, including but not limited to falling into the water, injury, drowning, collision, slipping, changing weather conditions, wind, current, cold water, and other unexpected circumstances.
All participants take part voluntarily and at their own risk.
SUP Prague will take reasonable steps to organize the activity safely, provide instructions, provide suitable equipment, and supervise the activity. However, SUP Prague is not responsible for injuries, loss, damage, or consequences caused by unforeseeable circumstances, weather, river conditions, participant behavior, failure to follow instructions, or personal negligence.
Participants are advised to have their own personal insurance.
5. Safety Instructions and Equipment
All participants must follow the instructions of SUP Prague staff at all times.
Participants must use the provided equipment properly and responsibly.
Safety equipment, including life jackets where required or instructed, must be worn as directed by SUP Prague staff.
Participants must not intentionally damage equipment, behave recklessly, jump from boards or boats unless instructed, push other participants into the water, or act in a way that may endanger themselves or others.
6. Equipment Damage or Loss
All equipment provided by SUP Prague must be returned in the same condition as received, except for normal wear and tear.
The booker and/or the responsible participant agree to compensate SUP Prague for any damage, loss, or destruction of equipment caused by negligence, misuse, reckless behavior, or failure to follow instructions.
This may include, but is not limited to, damage to paddleboards, paddles, canoes, kayaks, life jackets, dry bags, phones, accessories, or other equipment used during the activity.
7. Weather, River Conditions and Cancellation by SUP Prague
SUP Prague reserves the right to cancel, postpone, shorten, or modify the activity at its discretion due to weather, wind, storm risk, unsafe river conditions, technical issues, lack of participants, safety concerns, or any other circumstances beyond reasonable control.
If SUP Prague cancels the activity due to unsafe weather or river conditions, participants may be offered a rescheduled date or refund according to the booking conditions.
Light rain, cloudy weather, or normal changes in weather are not automatically considered valid reasons for cancellation.
8. Cancellation and Refund Policy
No refunds are provided for cancellations made less than 24 hours before the scheduled activity, unless SUP Prague cancels the activity due to safety, weather, or river conditions.
Refunds are granted according to the cancellation policy of SUP Prague or the booking platform/agent through which the booking was made.
If the activity was booked through a third-party platform or booking agent, any refund must be requested directly through that platform or agent.
Late arrival, no-show, refusal to participate, intoxication, unsafe behavior, or failure to follow instructions does not entitle the participant or booker to a refund.
9. Photos, Videos and Promotional Use
The booker and all participants acknowledge and agree that SUP Prague may take photos and videos during the activity.
These photos and videos may be used by SUP Prague for promotional, marketing, social media, website, advertising, and commercial purposes.
By agreeing to these Terms and Conditions, the booker confirms that they have informed all members of their group about this photo and video consent and that they agree on behalf of the whole group.
If any participant does not wish to be photographed or recorded, they must inform SUP Prague clearly before the activity begins.
SUP Prague will make reasonable efforts to respect such requests, but cannot guarantee that the participant will not appear in group photos, background footage, or wide shots taken during the event.
10. Personal Belongings
Participants are responsible for their own personal belongings.
SUP Prague is not responsible for loss, theft, damage, or water damage to personal items, including phones, cameras, clothes, jewelry, documents, wallets, glasses, watches, or other valuables.
Participants are advised not to bring valuables onto the water.
11. Group Conduct
Participants agree to behave respectfully towards SUP Prague staff, other participants, the public, and the surrounding environment.
Any aggressive, disrespectful, dangerous, discriminatory, or disruptive behavior may result in immediate removal from the activity without refund.
The group must follow all local rules, river regulations, and instructions given by SUP Prague staff.
12. Limitation of Liability
To the fullest extent permitted by applicable law, SUP Prague, its staff, instructors, partners, agents, and suppliers are not liable for any direct or indirect loss, injury, damage, accident, delay, inconvenience, or expense arising from participation in the activity.
Nothing in these Terms and Conditions excludes liability where such exclusion is not permitted by law.
13. Agreement
By booking, paying for, or participating in the activity, the booker and all participants confirm that they have read, understood, and accepted these Terms and Conditions.
The booker confirms that they are responsible for sharing these Terms and Conditions with all members of their group before the activity begins.
